An updated version of the unofficial interpretive guidelines for Sixth Framework Programme (FP6) on how and when to use the approved special clauses has been published by the Model Contract Working Group of the European Community.
The Commission has so far adopted 39 special clauses, which take precedence over any other contractual provisions, including Annexes I, II and III. They should be discussed during the negotiation phase with the Commission, but can be added to the contract later by way of amendment. The last clause was new special clause 39 which exempts certain contractors from the requirement to provide periodic audit certificates under Art. 7.2 of the model contract
